Refunds
Tickets:
All tickets bought through ibizaboatclub.com are flex tickets.
That means that they are valid for any event date in the future in case you can't come to the booked event date. No refund for no shows or late arrivals. 

Customers need to get in touch with us to be rebooked to another date than initially booked latest 24 hours before the booked event date. No rebooking possible after the event date has passed. No refund for no shows or late arrivals on the day of the event.

Event tickets will only be refunded by Ibiza Boat Club in case of event cancellation and only for tickets bought on ibizaboatclub.com. In case you bought your ticket with another seller, please read their T&C or get in touch with them for that. The purchase price will be refunded, but not any advance booking fee, shipping costs, travel costs or any other fees and costs.

Customers must arrive at the check in to redeem their ticket for a wristband 90 minutes prior the event latest. The check in starts approx 2,5 hours before the event.

The organiser reserves the right to change the time within 48 hours and/or venue of the event. The event tickets retain thereby their validity.
CDLN Ibiza reserves the right to reschedule the boat party to another time within 24 hours with no refund.

Merchandise:
Our refund policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange. 

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. 

Several types of goods are exempt from being returned.  
Non-returnable items: 
- Gift cards 
- Tickets
- Digital goods

To complete your return, we require a receipt or proof of purchase. 

There are certain situations where only partial refunds are granted (if applicable) 
- Obvious signs of use 
- Any item not in its original condition, is damaged or missing parts for reasons not due to our error 
- Any item that is returned more than 30 days after delivery 

Refunds (if applicable) 
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. 
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days. 

Late or missing refunds (if applicable) 
If you haven’t received a refund yet, first check your bank account again. 
Then contact your credit card company, it may take some time before your refund is officially posted. 
Next contact your bank. There is often some processing time before a refund is posted. 
If you’ve done all of this and you still have not received your refund yet, please contact us at info@ibizaboatclub.com. 

Sale items (if applicable) 
Only regular priced items may be refunded, unfortunately sale items cannot be refunded. 

Exchanges (if applicable) 
We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at info@ibizaboatclub.com and send your item to: Play Marketing S.L.U., Avd. d'España 1, Piso 1D, 07800 Ibiza, Balears, Spain. 

Gifts 
If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you. 

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he will find out about your return. 

Shipping 
To return your product, you should mail your product to: Play Marketing S.L.U., Avd. d'España 1, Piso 1D, 07800 Ibiza, Balears, Spain 

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. 

Depending on where you live, the time it may take for your exchanged product to reach you, may vary. 

If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from ibiza-boat-club.myshopify.com (the “Site”). 

Personal information we collect 
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.

How do we use your personal information? 
We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

We share your Personal Information with third parties to help us use your Personal Information, as described above. When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

This website is operated by Ibiza Boat Club. Throughout the site, the terms “we”, “us” and “our” refer to Ibiza Boat Club. Ibiza Boat Club offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. 

Please read these Terms of Service carefully before accessing or using our website, buying a ticket and/or attending an event. By accessing or using any part of the site and service, you agree to be bound by these Terms of Service. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

THE ONLINE STORE & SERVICE

Any reliance on the material on this site is at your own risk. 
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. We reserve the right to limit the quantities of any products or services that we offer. CIRQUE DE LA NUIT IBIZA

SECTION 13 - BOAT PARTY TICKET INCLUSIONS
Your CDLN Ibiza ticket includes the boat party, the pre party at Bora Bora and at least 3 club entries. 
The boat party includes open bar (beer, sangria, sex on the boat cocktails, Malibu pornstars, water, soft drinks), as well as a swim stop with professional life guards on duty and champagne showers.

The execution of the swim stop and the champagne spray show is subject to weather and water conditions. 

The boat party runs from 5.30pm – 8.30pm.
The check in starts at 2.30pm at Bora Bora Ibiza.
Please arrive at the pre party / redemption early with your ticket and ready to board the boat. You must exchange your ticket for a wristband 90 minutes before departure (4.00pm). CDLN staff will then walk you to the boat approx. 30 min before departure (5.00pm).
Boarding is at 5.20pm.

If you don’t redeem your ticket for wristband 90 minutes before departure, your boat entry is not guaranteed in case that the boat is fully booked. If there’s space on the boat on any of the next days CDLN will rebook you. This is a voluntary service and depends on availability. There is no refund for no-shows or late arrivals.

SECTION 14 - CLUB DEALS
The Cirque de la Nuit Ibiza ticket includes at least 3 entries to Ibiza’s night clubs within a week around the boat party. Those club entries change weekly according to day, month, event and availability and we cannot promise any specific club or event. The club deals are not officially announced online for several reasons. Please message or call Cirque de la Nuit Ibiza for further information about the club deals.

Please be aware that there might be weeks in pre & past season (April, May, June, September, October) when not all clubs are open every day. In those times we offer as many tickets and entries as possible.

Your CDLN e-ticket for the boat is not valid for the clubs. You need to pay the full price of the ticket in order to get the club entries. In case you want to use the clubbing pass before the day of the boat party, please contact us and we can arrange your ticket pick up. This offer is only valid for tickets bought on cirquedelanuitibiza.com and ibizaboatclub.com. 

SECTION 15 - FORMENTERA BEACH HOPPING TICKET INCLUSIONS
The ticket includes a 4 hours day cruise along Formentera's coastline aboard the Ibiza Boat Club, unlimited cocktails (offer may vary), Paella live cooking show, seasonal salad, seasonal fruits and snorkelling equipment. 

The route of the tour is subject to weather, wind and water conditions. The captain decides on the day of the tour which beaches are safe to explore and to sail to. We cannot promise to approach any specific beach or cove.

SECTION 16 - MODIFICATION OF THE SERVICE OF CIRQUE DE LA NUIT
The organiser reserves the right to change the time within 48 hours and/or venue of the event (no matter which one). The event tickets retain thereby their validity.

SECTION 17 - DISCLAIMER
Excessive drinking on a boat is dangerous. CDLN is committed to promoting responsible alcohol consumption. Any use of drugs won’t be tolerated. Anyone not adhering to this will not be allowed to board the boat or receive a refund. In case of anybody being too drunk once onboard, the person will be taken their wristband off and won't be allowed to drink anymore.

Travelling on the boat is at your own risk. The vendor accepts no responsibility for any injuries sustained while on board, although the boat is insured under Spanish law.

SECTION 18 - MARKETING PURPOSES OF THE EVENTS

With the purchase of a ticket the customer agrees to the commercial use of photo and video material etc. taken during the events of Play Marketing S.L.U. without prior notice. Play Marketing S.L.U. owns the material and is allowed to use it in any form for an unlimited time.

You can always request Ibiza Boat Club and / or Cirque de la Nuit Ibiza to send you material that has been taken.

GENERAL TERMS & CONDITIONS

SECTION 19 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY 
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. 
We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. 
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. 
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. 
In no case shall Ibiza Boat Club, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. 

SECTION 20 - INDEMNIFICATION 
You agree to indemnify, defend and hold harmless Ibiza Boat Club and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. 

SECTION 21 - SEVERABILITY 
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions. 

SECTION 22 - TERMINATION 
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
